State Commission has dismissed the appeal as barred by time.  There was a delay of 47 days in filing the appeal.  Petitioner has explained that he could not file the appeal within time, as he had undergone eye surgery.  According to us, sufficient cause for condonation of delay was made out and the State Commission has erred in non-suiting the petitioner on the ground of limitation.

        The delay of 47 days in filing the appeal is condoned.  Order of the State Commission is set aside.  The case is remitted back to the State Commission to decide it afresh on merits in accordance with law.

        Parties are directed to appear before the State Commission on 13.12.2011.
