1. The complainant who is a consumer for electricity supply under opposite party prays to set aside the invoice dated, 12-6-2007 for Rs.9,232/- and another bill of the same date for Rs.3,989.56/-. Opposite party filed version denying the allegations in complaint and contended that the bills issued are proper and legal. Both sides filed affidavits by way of evidence in support of their pleadings. Exts.A1 and A2 marked on the side of complainant. Exts.B1 to B4 marked for opposite party. When the matter was posted for hearing on 31-12-2008 counsel for complainant filed a statement that he is withdrawing all the contentions in the complaint. It is submitted in the statement that he is liable to pay the bills disputed in the complaint and requested for installment facility to remit the amount. In view of this statement we do not consider that it is necessary to enter into the merits of the case. We also find it is only just and proper to allow the complainant instalment facility to remit the amount.

     

2. In the result we dismiss the complaint with direction to opposite party to allow the complainant installment facility of at least three instalments to remit the amount as per Ext.A1 and A2 bills without any surcharges. The time limit for compliance of this order is two months from the date of receipt of copy of this order.
