Shri Sudip Majumder- President-in-Charge.

Today is fixed for hearing on the petition filed by the complainant dated 02/01/2024 and W/O if any by the OP sides. Both the parties files hazira through their respective Ld. Advocates. The complainant files a petition for amendment with copy.

            One amendment petition has been filed by the complainant. The same has been registered as M.A. Case being No. 69/2024. Record is now taken up for hearing.

            Perused the petition. Considered. Heard Ld. Advocates for the both sides.

From the content of the petition it appears that Kabita Kaviraj, W/o. Samadhish Kaviraj of      Vill. and P.O.- Kusumba, P.S.- Rampurhat, Dist.- Birbhum, W.B. is necessary to implead as OP No. 3 whose presence is necessary to adjudicate this case.

            Ld. Advocate for the OP is present at the time of hearing and no objection raised in respect of allowing the prayer for amendment as sought for by the Ld. Advocate for the complainant.

            In the instant case, this Commission is of view that if the prayer for amendment as made by the complainant would be allowed by this Commission that cannot change the nature and character of this case because it is formal in nature.

Hence, the amendment petition being M.A. Case being No. 69/2024 is considered and allowed on contest without any cost.       

Thus the M.A. Case being No. 69/2024 is disposed of.

            Fix. 09/07/2024 for filing amended complaint and steps by the complainant.

Copy of this order be supplied to the parties each at free of cost.
