ORDER

By Smt. Padmini Sudheesh, President. The averments in the petition is as follows: The petitioner is a consumer of R1 and R2 and the number is G.1579. He was enjoying the connection for agricultural purposes and remitted the charges promptly. On 1998 he had applied to the Agriculture Office for exemption. No information is received, whether included in the exemption list or not. So he continued to pay the charges. On one occasion the Cashier of the concerned K.S.E.B. directed the petitioner since he have applied to exemption he need not pay the charges and endorsed on the back of his consumer card that “free from 4/97 to 3/98. From that time onwards he never paid the charges. But a notice dated 17/9/07 is served by R1,stating that if Rs.2704/- and arrears is not paid within 3/10/07 the connection will be dismantled. They have no right to do that. Hence the petition. 2. The notice issued from the Forum is accepted by all and never turned up. No Counter is also filed. 3.To prove the case of the petitioner he has produced two documents and marked as Exts. P1 to P5. 4.The petitioner is appearing in person and heard the petitioner and perused the documents. 5.The only point for consideration is whether he is entitled for the exemption permitted to the agriculturists. 6. Ext.P4 is the letter by R1 to R2. The letter shows that for avoiding the case pending before the Forum,the R2 is required to verify whether the petitioner is in the exempted list or not. In reply the Agricultural Officer stated that the Consumer No.G.1579 is included in the agricultural exemption scheme. So he need not pay the electricity charges from the date of inclusion in the list. Here the date is not furnished before. 7. In the result the petition is allowed and the 1st and 3rd respondents are directed not to collect the arrears from the date of inclusion of his name in the exemption list. And further directed not to dismantle the connection. R2 is directed to furnish the details to R1 and 3 within one month. Dictated to the Confdl.
