Heard applicant in person.

            Present application is filed for allowing him to withdraw the amount deposited by M.S.E.D.Co.Ltd. in this Commission.  Applicant submitted that complaint bearing No.518/2008 had been allowed in his favour and M.S.E.D.Co.Ltd. was directed to pay Rs.22511/- with interest @ 10% from 28.11.2008.  He submitted that M.S.E.D.Co.Ltd. had preferred the appeal No.464/2009 in this Commission against the said order alongwith application for condonation of delay.  Application for condonation of delay has been dismissed, consequently appeal was dismissed by this Commission.  He submitted that M.S.E.D.Co.Ltd. had deposited  amount in the Commission while filing appeal.  As appeal has been dismissed, he submitted that he is entitled to withdraw the amount. 

            Applicant is entitled to withdraw the amount deposited by the appellant towards award . Application is disposed of.
