1. Complainant’s case in short is that he purchased two Jeevan Anand Policies of LIC on 17.02.2018 vide Policy No. 549512000 & 549512001 for sum assured Rs. 3,00,000/- each for which regular premium was being paid. Further case is that the agent Dharapati Gorai has assured the complainant that as per policy in case of accident or danger sum assured shall be paid to the complainant. Further case is that on 17.03.2020 both leg of the complainant became damaged due to accident for which he went at the office of O.Ps. for payment of the money as per policy but officials of the  O.Ps. have not helped the complainant and refused to make payment, for which complain was made to the IRDA, having no impact, lastly legal notice was served, which was not replied by the O.Ps. Hence this case has been filed with prayer to direct the O.Ps. to pay total Rs. 6,00,000/- as sum assured of both the policies , to pay Rs. 2,00,000/- for physical and mental harassment and also to pay Rs. 25,000/- as legal expense to the complainant.
2. O.Ps. appeared, but have not filed W.S. hence vide order dt. 15.04.2023 they have been debarred from filing W.S.
3. Complainant has filed photo copy of policy papers, photo copy of pathological reports, CT Scan Report etc. of the complainant. He has also filed photo copy of premium payment receipts, photo copy of legal notice and photo copy of treatment papers. Complainant has filed his evidence on affidavit. On careful perusal of those papers it is apparent that complainant was subjected to sum medical examination and treatment but from these papers it is not being proved that complainant has approached the O.Ps. for settlement of his claim.

Record shows that on 22.05.2023 O.Ps. have filed an application mentioning therein that complainant has not filed any claim form before the O.Ps. for redressal of his grievance and LIC is ready to pay the real claim amount on filing of claim form with documents by the claimant. Hence it is prayed to pass necessary order in this regard.

 

5. Ld. Counsel for the complainant admits that no any claim form has been submitted before the O.Ps. for settlement of the claim due to non cooperation by the O.Ps.

 

6. In the given facts it is very much clear that without approaching the O.Ps. by filing claim form with relevant papers, complainant has filed this case. Hence this case is being dismissed with direction to the complainant to approach the O.Ps. by filing appropriate claim form with all supportive papers and on filing it O.Ps. shall consider the claim as per norms. In the facts and circumstance of the case parties shall bear their own costs.
