Final Order / Judgement

This is an order raising  out of a petition  no- 225/18  filed   by one Sri  Kumud Ranjan Das  in C.C.No-  4/2018  . The   petitioner   prayed for  passing  an interim   order  directing   the  opp. party  i.e.  Assam  Power  Distribution  Co Ltd.  And others  not to disconnect    the power  connection   in connection  with Consumer ID No- 52000023414  and not  to  charge the re-estimate  of Rs. 41, 603/- . This   forum  after  hearing  the ld.  Counsel  for the  petitioner  passed   an interim order   found  the prim-facie case  and  irreparable  loss in  favour  of the complainant  and accordingly  opp. parties  were  directed   not to  disconnect   power   connection   to the  house  of the  complainant  vide Consumer ID No. referred above  and not to  realize  the amount of  Rs. 41,603/-  until  disposal   of the  petition.   The show cause  notice  was  issued  and opp. party filed   written objection   on 14/12/2018  with  a prayer   to dismiss  the petition   and to  vacate   the interim order.  It is   further submitted  in   the objection   petition   that there is  no negligence  as well as  deficiency  in service    as  defined  U/S- 2(d)   of the  Consumer Protection Act,1986 . It is further submitted    in the  petition   that illegal  re-estimated  in energy  charge  against   the  opp. party  is baseless , concocted and  devoid  of any   merit.   It is   further   submitted   that bill  for the month of  02/09/2017  to 01/10/2017  has deposited through   cheque  was  later  dis-honoured and   for the  computer technical  problem  the amount of Rs.41,603/-  as re-estimated  energy charge was  recorded  instead  of outstanding  charge.

 

At the  same time , the opp. party  have  submitted  a petition   today  itself  showing   the  fact  that they  are  paying  the electricity bill  continuously  after  getting  such order. From   this forum   as the main suit  is pending for   determination and   decision   we do  not  like to   get   involved   in the   merit   of the  matter  which  are  the subject  matter  of the  original suit.  But  however,  the balance inconvenience is found  in favour  of the   petitioner  and hence   we are of the opinion   that  the interim  order  passed  by this   forum on  07/03/2018 is made  absolute . The  mis. case  is accordingly  disposed of.
