This is an application filed by  the   complainant  Smti  Bhanu Baruah   vide   petition no-  2331  dtd. 25/5/2023   duly  signed  by the   ld.  counsel   Smti  S Deka   annexing   an affidavit    sworn    by the    complainant . The   aforesaid  petition is   filed   under   Order-XXIII  Rule-1  read   with  151 CPC  for  withdrawal  of the   case   filed  by     the   complainant.  At para  9 of  withdrawal petition    the   complainant   have   specifically   mentioned   that   complainant  is   an  old lady  suffering  from  age  related  ailment   and  therefore   has   filed  this     instant  application   under   the   provision   of law  to withdraw   the    instant  case   without the  leave   of   this    Hon’ble  Court  for the   ends of justice. Heard ld. counsel   appearing  Smti S.Deka   for the   complainant  & Smti  M.Bose   for the  opp.  party.

After   due hearing   we are   of the   opinion  that  withdrawal   petition under  order  XXIII  Rule 1   of CPC   is allowed.   The case   is dismissed   on withdrawal.
