ORDER

D.Hr. and the J.Dr. counsels have filed two separate memos also signed by the respective parties. D.Hr. in his memo reports the receipt of entire amount due in this execution and undertaken to get the criminal case No.PCR 792/06 dismissed which has been filed on the basis of cheque bearing No.972160, and to dismiss the execution petition as fully satisfied. In the memo filed by the J.Dr. he has undertaken that he will not misuse the on demand promote note and a cheque issued to him against the D.Hr. in any way in future. With this the counsel for both the parties submitted for closing the execution petition. In view of the above memos filed by both the parties, D.Hr. is directed to withdraw the criminal case filed against the J.Dr. under section 138 of Negotiable Instrument Act and J.Dr. shall also not to mis-use the on demand promote note that are in his custody, executed by the D.Hr. with this execution petition is closed as fully satisfied.
