This revision petition has been filed under Section 58 (1)(b) of the Act 2019 in challenge to the Order dated 13.05.2022 of the State Commission in revision petition no. 06/2022 arising out of the Order dated 26.02.2022 of the District Commission in complaint no. 217 of 2021. 2. The impugned Order of the State Commission is reproduced below for reference: Sh. Mukesh Nautiyal, Ld. Cousnel for the revisionist is present. He states that this revision petition may be dismissed as withdrawn, because appeal will lie against the impugned judgment and order passed by the District Commission. Accordingly, the revision petition is dismissed as withdrawn. Let the record be consigned. 3. The learned counsel submits that there appears to be some miscommunication in respect of the submissions of the counsel for the appellant made before the State Commission on 13.05.2022 while hearing the appeal. He fairly admits that no review application under Section 50 of the Act 2019 in that regard was filed before the State Commission and submits that he wants to withdraw the instant revision petition filed before this Commission and would prefer to file a review application before the State Commission. 4. In the wake of the above submissions, the instant revision petition no. 561 of 2022 hence stands dismissed as such. 5. The Registry is requested to send a copy each of this Order to the parties in the petition and to the learned counsel for the petitioner immediately. The stenographer is also requested to upload this Order on the website of this Commission immediately. |
