Sh. Rishu Singla, Advocate counsel for OP No.2 has suffered a statement that the OP No.2 is ready to refund the purchase price of mobile set in question to the complainant subject to deposit of Original Mobile set alongwith accessories with the Samsung Service Care Centre ( i.e OP No.3) within 45 days from the date of deposit of mobile set by the complainant.

Sh. Birdevinder Singh, Advocate counsel for complainant has suffered a statement that he has heard the statement suffered by Sh. Rishu Singla, Advocate counsel for OP No.2. In view of the statement suffered by counsel for OP No.2, he withdraws the present complaint.

In view of the statement suffered by counsel for complainant as well as counsel for OP No.2 the present complaint is dismissed as withdrawn with a direction to the OP No.2 to pay the purchase price of the mobile to the complainant within 45 days from the date of receipt/deposit of mobile set by the complainant with the service center ( i.e OP No.3 ). The complainant is directed to deposit the mobile set alongwith accessories with OP No.3.  The parties will be bound by their statements. File be indexed and consigned to record.
