As Dr. (Mrs) Monika Malik :   

    

                       This appeal filed by the opposite parties/appellants is directed against the order dated 05.08.2014 passed by the District Consumer Disputes Redressal Commission, Indore (For short ‘District Commission’) in C.C.No.839/2012.

2.                The complainant had filed a complaint alleging deficiency in service on part of the opposite parties before the District Commission for allegedly selling inferior quality bed, mattresses and dressing table to the complainant.

3.                The District Commission vide impugned order allowed the complaint and directed the opposite parties to refund the cost of furniture

i.e. Rs.29,900/- within two months to the complainant, after obtaining furniture from him. In addition compensation of Rs.2,000/- with costs of Rs.1,000/- has also been awarded.

4.                During the course of hearing learned counsel for the appellants submits that appellants have carried out the repair work upto the satisfaction of the complainant and the complainant/respondent is ready to withdraw his complaint.  

5.                Learned counsel for the complainant/respondent affirmatively submits that the complainant wishes to withdraw the complaint filed before the District Commission.

6.                In view of the above, this appeal which is rendered infructuous, is accordingly disposed of.

7.                Needless to mention that the pre-deposit amount deposited by the appellants before the District Commission in order to file this appeal, be returned to the appellant.
