This matter was listed for hearing on 22.08.2011 but that day the record was not traceable and therefore, it was not kept before this bench. Now the record is traced out. Therefore, it is taken on today’s board.


 

 


 

Adv.Mr Amit Madiwale for the applicant is present and submitted Pursis alongwith copy of application for condonation of delay, which was caused for filing the application for restoration of appeal, etc.


 

 


 

Undisputedly, appeal No.A/98/2658 was dismissed for default on 30.03.2007. Mr Madiwale, Advocate appearing for the applicant submitted that there is sufficient ground to restore the appeal.


 

 


 

Though there is sufficient ground for restoration of appeal, since this Commission has no jurisdiction to restore the appeal, which was dismissed for default, cannot be entertained and restored.


 

 


 

Hence, this application being not at all maintainable before this Commission, stands dismissed.


 

 


 

No order as to cost.


 

Copy of this order be supplied to the parties.
