This is a case of medical negligence.

It appears from the record that the petition dated: 07-01-2015 filed by the complainant is pending for hearing for a long time. By the aforesaid petition a medical enquiry report has been called for from Ld. Assistant Public Prosecutor attached to the Court of Ld. Judicial Magistrate, 4^th Court, Bankura in connection with Bankura P.S. Case No.297/11, dated: 08-12-2011. The case was at the stage of argument and due to pendency of the petition the case cannot be concluded after hearing argument. The aforesaid petition is somewhat mis-conceived as the Commission cannot call for any such report connected with any case from the Ld. Assistant Public Prosecutor.

The report if necessary may be called for from the concerned Court where said report has been filed.

The complainant is given liberty to call for the said report from the concerned Court at the time of argument.

To 22/02/2023 for argument.

M/A 09/2017 is thus disposed of.
