Present:-    None for the appellant.

                   Mr. Munih Behl, counsel for the respondent No.1.

                   Mrs. Meenakshi Dogra, proxy counsel for Mr.Sachin Ohri, counsel for respondent No.5.

 

                   As per the report of registry, notice could not be issued to the respondents No.2 & 4 for want of correct address whereas notice issued to respondent No.3 not received back in any form either served or unserved.

                        This appeal is lingering on for causing appearance of respondents No.2 to 4 before this Commission and their correct addresses have not been filed since last four dates as it is so visible from repeated office reports. This appeal pertains to the year, 2018. This Commission does not see any reason to adjourn this appeal for the purpose of issuing notice to respondents No.2 to 4. It seems that there is sheer laxity on the part of the appellant in above context, which is ex-facie visible on record. Consequently, present appeal is hereby dismissed qua respondents No.2 to 4 for non-prosecution.

                        Today, nobody has represented appellant. On last many dates of hearing i.e. on 17.07.2019, 07.11.2019, 24.08.2022, 25.05.2023, 09.11.2023, 12.04.2024, appellant was represented by proxy counsel. Present appeal is pertains to year, 2018, and since 30.04.2018; appellant is enjoying interim stay. Appeal has been called several times since morning. It is already 1.50 P.M. No further wait is justified. It appears that appellant is no more interested to pursue this Appeal in order to take it to its logical end. Hence, present appeal is hereby dismissed, not only in default owing to absence of counsel for appellant, but also for its non-prosecution. It is ordered accordingly.
