ORDER

Today, none is present on behalf of the respondent/ complainant. The respondent/complainant has moved a written request for an adjournment.

In view of order passed by Hon’ble National Consumer Disputes Redressal Commission, New Delhi on 27.02.2019 in Revision Petition No.2168 of 2018, which reads thus:-

“In a Consumer Complaint filed by the respondent, the District Forum had directed State of Haryana to invite the complainant Ashok Kumar Prajapat in the meetings of District Removal of Grievances Committee as well as District Tobacco Control Cell.  The said direction having not been complied, he directed personal appearance of the Director, State Transport, Haryana     and Additional Chief Secretary to Govt. of Haryana, Health Department, on several dates.  Since they did not appear before the District Forum, the application filed by the petitioners for exemption from their personal appearance was dismissed and bailable warrants of their arrest were directed to be issued.

2.      After hearing the complainant as well as the learned counsel for the petitioners, I am satisfied that the personal appearance of the above referred officers is not necessary at this stage, provided that they are represented by a duly authorized counsel.  The complainant, who is present in the Court, states that he does not insist upon the personal appearance of petitioners no.1 & 3 before the District Forum provided that the petitioners are duly represented by a counsel on every date of hearing.  In view of the said statement, the Revision Petition stands disposed of with an order that petitioners no.1 & 3 need not appear personally before the concerned District Forum during pendency of the Consumer Complaint provided that a counsel duly instructed by the petitioners remain present on every date of hearing.”

Counsel for the revision petitioners states that this revision petition has become infructuous.

Accordingly, this revision petition stands disposed of having become infructuous.

Certified copy of this order be sent to the parties free of charge.
