Petitioner earlier filed MA 103/2011 seeking permission to sell the vehicle fixing the minimum price of Rs.6 Lac and deposit the same with this Commission in order to avoid any further liability as the truck was a depreciable asset.  Later on, petitioner filed the present application bearing No.659/2012 stating therein that the petitioner had wrongly fixed the minimum value of the vehicle at Rs.6 Lac; that the same should have been Rs.4 Lac.  Petitioner has annexed reports showing that the value of the vehicle was not more than Rs.4 Lac.

             Notice on this application was issued to the respondent.  Respondent has been served and reply has been filed.  In the reply respondent stated that he has no objection to the sale of the vehicle provided the amount is kept deposited with the Registry.

             IA is allowed.  Petitioner is permitted to sell the vehicle fixing its price at Rs.4 Lac. 

             Petitioner is also directed to deposit the amount of the sale proceed with this Commission.  Registry is directed to keep the same in continuous FDR till the disposal of the revision petitions.
