JUDGEMENT & ORDER

Complainant Shri Makyem Lego present in person.  Shri Kipa Talling, Secretary AVF present on behalf of Arunachal Vidya Foundation, Itanagar.

Brief of the case is that the complainant Shri Makyem Lego, Paglek Village, Pasighat took admission for 2 years B.Ed course in Arunachal Vidya Foundation, the opp. Party through its Branch office at Pasighat. He paid Rs. 5000/- as registration fee and Rs. 25,000/- as first installment. The Opp. Party was offering B.Ed degree through distance education by affiliating with Prist University, Kerala. In the mean time, the Opp. Party found that the university was not recognized by Distance Education Council of India. After revealing the fact, they discontinued to offer the course and announced to refund the fees to students. But it was delayed in refunding the fees to the complainant. So, this complaint.

As per provision of sec 13(a) of the Consumer Protection Act, 1986, a copy of the complaint letter was forwarded to the opp. Party seeking their version. In their reply, the opp. Party stated that they have not refused to refund the amount but sought time to confirm his admission from the record as his name was not in the list furnished by the Manager of Pasighat Branch. By the time, all the records and documents were taken into Head office following dissolved of Pasighat Branch in March, 2014.

Mr. Kipa Talling, Secretary AVF stated that as Shri Tai Taggu, the then Manager of the Pasighat Branch of AVF forgot to mention complainant’s name in the list of students who have taken admission in Pasighat branch. Besides, all the records and documents were brought to the Head office following dissolution of the Branch office in March, 2014 which delayed to solve his case.

Heard both the parties and observed that the money receipt bearing No. 801 and 192 issued for registration and admission fees submitted by the complainant reveals that the transaction was made prior to dissolution of the Pasighat Branch when Shri Tai Taggu was authorized agent of the Opp. Party. The opp. Party also agrees to refund the fees collected from the complainant.

With the above discussion and observations, the Arunachal Vidya Foundation, Itanagar is directed to refund the registration fee of Rs. 5,000/- and admission/ first installment fees of Rs. 25,000/- along with Rs. 1000/- towards other expenses to the complainant Shri Makyem Lego within 2 (two) months from date of order.

With this, the case is settled.

Copy of this order be served to both the parties.
