Appellant/Respondent as well as their respective counsel are absent. As the parties were absent since long notice was issued to both the parties The report of the notice issued to the appellant is not received. On perusal of the office copy of the notice it reflects that it was issued on the correct address of the appellant as shown in the appeal memo. In Response to the notice Respondent Arun had appeared before this commission on last date i.e.29/9/2011.However, despite issuing notice on the correct address of the appellant, he is absent. Therefore, it will have to be presumed that the directors of the appellant are served with notice, but they did not turned up. Therefore, the appeal deserves to be dismissed in default. Accordingly the appeal is dismissed in default. No order as to costs.
