ORDER

This is a complaint praying to direct the opposite party to construct the balance portion of the complainant's house as per the terms and contract entered between them and on his failure directing him to pay a compensation to the complainant a sum of Rs.5,00,000/- with interest and cost and to pass necessary orders in the interest of justice.

2.         Summons served to the opposite party.  The opposite party appeared through his counsel and filed reply version. An Engineer from Public Works Department, Karaikal was appointed to inspect the site and to file report.  After inspection, the Engineer filed his report and the same was marked as Ex.X1 when he was examined as court witness before this court.

3.         Today the complaint was called.  Complainant absent and his counsel absent, no representation made.  The opposite party absent, counsel represented.  No interest shown  by the complainant to proceed the matter.  Hence this complaint is dismissed for default. No cost.
