Appeal No 94 of 2017

16.05.17          Appellant present. On behalf of the respondent no.1 Vakalatnama is filed. Heard learned counsel for the parties. Mrs Sheela Sharma learned counsel appears for the respondent no.2 and received a copy of memo of appeal of our instance to expeditious disposal of the case.

                   The delay in filing the appeal is condoned on considering the submissions and grounds stated in the limitation petition.

                   Learned counsel for the appellant submits that there discrepancies in registration number of the vehicle as such claim was not payable. Learned counsel for the respondent no.1 submits that the issue which has been raised in this appeal was not subject matter either in the submission before the District Forum nor the written statement filed on behalf of the appellant. This apart it is submitted that there is not discrepancies in the registration number since temporary number was mentioned in the First Information Report and in the claim before the insurance company the permanent registration number was mentioned as such there is no discrepancies justifying the repudiation.

                   We have considered the submissions and perused the impugned order. We find that the District Forum has considered the matter in correct perspective needs no interfere. The point raised on behalf of the appellant regarding the discrepancies in the registration number is without any substance and as such the  impugned order stands affirmed and appeal is dismissed at the admission stage itself. However the time of two months for payment  as allowed by the District Forum is extended by another period of two months on receipt/production of the certified copy of the present order. The assured amount payable to the complainant be to the remitted respondent no.2 M/S Mahendra & Mahendra Financeial Services Ltd. Patna from whom complainant availed the loan for purchase of vehicle in question against for adjustment the loan dues. The surplus if any will be returned back by the respondent no.2 to the complainant without delay. The appeal stands disposed of as above.
