Ld. Counsel for the complainant files a petition stating that in this case, a cheque of compromise amount has been disbursed in favour of the complainant. Therefore, the complainant is not willing to proceed with the case further. In this context it is important to mention here that due to illness the complainant is unable to appear before this Forum today. So it is now necessary to pass appropriate order by disposed off this instant case, otherwise, the complainant will suffer severe loss and injuries and prayer is made to dispose of this case will full and final satisfaction.
It is found from the record that previously a talk of compromise had been going on between the parties and from the order No. 09, dated 09.02.2018 it is evident that a cheque bearing No. 964148, dated 23.02.2018 amounting to Rs. 16, 24,280=00 has been handed over to the complainant and the complainant has received the cheque from the Ops with full and final satisfaction of his claim and the complainant has no further demand against the Ops to this respect. The ld. Counsel has further submitted that as the cheque amount is a large amount, so a date may be fixed for final disposal of this complaint after encashment of the said cheque amount in the Bank account of the complainant.
Today by filing petition as the ld. Counsel for the complainant submitting that the complainant is willing to dispose of the present complaint with full satisfaction, so there is no bar to dispose of the present complaint.
Hence, it is
O r d e r e d
that the present Consumer Complaint being No. 160/2017 be and the same is disposed of with full and final settlement. There is no order as to costs.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
