    That the complainant agreed to purchase a Detachable TV Shelf  from the opposite party, Arafa Crafts, for an amount of Rs.4950/- for which he paid Rs.500/- as advance on 9/4/08.  The date of delivery of the  article was on 25/4/08.  But so far the opposite party has not delivered the above said  TV shelf inspite of the repeated demands of the complainant.  Hence the complaint filed for necessary reliefs.

2.  The notice issued to the opposite party was returned unclaimed .  Hence opposite party called  absent and set exparte.

3.    The brother of the complainant, Abdulkhader  Muneeb as the authorized agent,  is  examined as PW1 and Exts.A1& A2 marked. 

4.      The case of the  complainant is that he paid Rs.500/- as advance for the TV.Shelf is evident from Ext.A1, the receipt issued by opposite party.  The delivery  date shown in Ext.A1 is 25/4/08,  now more than one and half year is elapsed.  According to the complainant inspite of his repeated demands the opposite party  declined to deliver the article.  What is deposed by the  agent of the complainant before the Forum is not challenged by  the opposite party.  The non delivery of the article  within the stipulated time as agreed amounts to unfair trade practice on the part of the opposite party.

       Hence the complaint is allowed.  The  opposite party is directed to  refund Rs.500/- to the complainant as the advance consideration paid wih,  Rs.2000/-  towards compensation for mental agony and sufferings  and Rs.1000/- as cost of proceedings.  Time for compliance is limited to 30days from the date of receipt of copy of  the order.
