By Sri. Vinay Menon V., President

  1. Complaint was filed aggrieved by the allegedly defective memory card purchased by the complainant from the O.P. through a web portal.
  2. O.P. refused to accept notice and hence was set ex-parte.
  3. Complainant was continuously absent and failed to file proof affidavit within the time granted. Hence the matter was taken for orders based on merits.
  4. Since the pleadings had not matured into evidence by way of proof affidavit and marking of documents and the complainant chose to remain absent, we presume that the complainant is not interested in furthering the dispute. Complainant has failed to prove the merits of his case.
  5.  Accordingly, complaint stands dismissed.

Pronounced in open court on this the  26th  day of  June, 2023.
