1.               The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has  prayed for direction upon the o.p. to execute and register the deed of conveyance with respect to the flat mentioned in the schedule and to pay  compensation to the tune of Rs. 1 lakh together with other reliefs as the o.p. in spite of receiving Rs. 51,000/- on  27-09-2006 out of total consideration money of Rs. 9 lakhs did not execute and register the flat in question on repeated requests.

 

2.               The o.p. in the written version contended interalia that the flat in question has already been sold as the complainant did not enter into any agreement for sale and requested the complainant to take refund of the said booking money of Rs. 51,000/- after deduction of  Rs. 10,000/-.  

 

 

3.        Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.P.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

 

 

DECISION  WITH   REASONS      :

 

 

4.               Both the points are  taken up together for consideration. Admittedly Rs. 51,000/- was received by the o.p. as advance money out of the total consideration of  Rs. 9 lakhs on 27-09-2006.  Surprisingly save and except the money receipt, the complainant has not filed any deed of agreement as no such agreement was acted upon between the parties. That apart the amount was paid in the year 2006. So this cannot be a case of part performance; nor the complainant has been in possession of the suit flat. By sleeping over his opportunity for a period of nearly 7 years, the complainant cannot expect any positive result from this Forum. This is a fit case for refund of the earnest money. Both the points are accordingly disposed of.   

 

 

      Hence,

                       

O     R     D      E      R      E        D

 

           

 

      That the C. C. Case No. 301 of 2013 ( HDF 301 of 2013 )  be  and the same is decreed in part  on contest against  the O.P. 

 

      The O.P. be directed to refund the sum of Rs. 51,000/- received as earnest money to the complainant within 30 days from the date of this order together with interest @ 9% p.a. failing the amount shall carry interest @ 12% per annum till full payment.  

     

      No order as to compensation.

 

      The complainant is at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
