            The case of the complainant filed on 08/01/14 is as follows.

            The complainant was joined the Chitty’s conducted by the 1st opposite party.  The 2nd and 3rd opposite parties are the Managing Director and Executive director of the 1st  opposite party.  According to the complainant he was joined in a chitty No. ATIJ/9818,9820 and the customer ID No. is 8187, conducted by 1st opposite party’s Thycaud branch, for valued sala Rs.20,00,000/-.  And chitty No. ATIJ/15832,15833,15834,15836 and customer ID No.13470 conducted by 1st opposite party’s Thiruvananthapuram East Fort Branch for valued sala Rs.1,00,00,000/-.  And in both chitty complainant remitted Rs.9,20,000/- and Rs.19,600/- as processing charge.  According to the complainant he had joined the chitty with the opposite party, on  believing the representation made by the opposite parties directly and the advertisement given by the complainant.  According to the complainant the opposite parties were closed their office without giving chitty amount as offered by them.  According to the complainant the act of opposite parties amounts to deficiency in service and unfair trade practice.  Hence this complaint.

          Notice to opposite parties were returned with an endorsement as ‘intimation’ ‘unclaimed’.  So it is considered as deemed service.

Points for determinations are:

  1. Whether there is any deficiency in service or unfair trade practice on the part of opposite parties?

  2. Reliefs and costs?

Evidence in this case consists of proof affidavit of the complainant and Ext.A1 to A6 documents.

Point No.1

          The brief of the case is that opposite parties were closed their office without giving the chitty price amount of Rs.9,20,000/-, remitted by the complainant.  Complainant produced the two pass book of the chitty and it is marked as Ext.A1 and A2.  Ext.A3 to A6 are the original cash receipts.  From Ext.A1 to A5 it can be seen that complainant was remitted Rs.9,20,000/- with the opposite parties. From Ext.A6 series it can be seen that opposite party had collected Rs.4500/- as processing charges.   In the absence of contra evidence we cannot disbelieve the case of the complainant.  In our view complainant is entitled  for Rs.9,24,500/- remitted by him and the act of opposite parties in closing the offices, after collecting the amount, without return the amount, amounts to deficiency in service and unfair trade practice.  Point No. 1 is  find accordingly.

Point No.2

          In view of the findings in Point No.1 complaint is allowed

          In the result

  1. Opposite parties are ordered to refund Rs.9,24,500/-, remitted amount, with 18%interest from the date of complainant till realization to the complainant.

  2. Since interest is allowed no separate compensation is ordered.

  3. Opposite parties are ordered to pay Rs.5000/- as litigation cost.

Order shall be complied with within 30 days from the date of receipt of copy of the order.
