This is the complaint filed under sec. 35 of the Consumer Protection Act, 2019, regarding the defective i-phone II PRO MAX purchased from the opposite party.
- The opposite party filed written version denying all the allegations and claims made against it.
- Today the case is posted for the affidavit of the complainant as last chance. But the complainant remained absent and there is no representation for him. The onus is on the complainant to prove the allegations. But the complainant failed to let in any evidence to prove the case so as to get an order as prayed for. The complainant is continuously absent and it appears that he is not interested in pursuing the matter. The allegations are not proved.
In the result, the complaint is dismissed. No order as to costs.
