A  Rajesh, President.

                At the stage of admission the maintainability  of this complaint itself  was considered.  According to the complainant, he is the absolute owner of 16.675 cents of land in Sy. No. 331/2B in Kakkanadu Village.  It is contended that he entered into an agreement with the opposite parties for construction of apartment in the property and as per the agreement the opposite parties agreed to hand over 31% of the built up area of the building together with undivided share in the property.  Since the opposite parties failed to do so, the complainant is before us seeking direction against the opposite parties to execute covenants in the agreement .

                We  have heard the counsel for the complainant and gone through the documents on record.  Admittedly the agreement between the complainant and the opposite party is joint venture agreement.  There is no relation of consumer and service provider between the complainant and the opposite party.   The remedy of the complainant lies elsewhere.   Since the complainant is not a consumer, the proceedings in this complaint is closed with a direction to the complainant to approach the appropriate authority is so advised.
