Complainant is present and files  a petition stating that the office of the OP is situated at  DN-53, Salt Lake, Sector – V, Kolkata – 700 093.

Today is fixed for SR and appearance.

No SR or appearance from the side of the OP.

It appears that  the office of the OP as per the petition of the Complainant filed as on this date is at   Salt Lake, Sector- V, Kolkata- 700 093. This Fora, accordingly, has not no territorial jurisdiction to hear the case.

 In terms of Section 11 of CP Act, a complaint should be instituted in a District Forum, within the local limits of whose jurisdiction the OP party actually and voluntarily resides or carries on business or has a branch office or personally works for gain. We find that the address of the OP is not within the jurisdiction of this Forum. Accordingly, we think the complaint case is maintainable in this Forum on the point of territorial jurisdiction.

 Let the instant complaint case be sent to the Registrar, Hon’ble State Commission for transferring the same to the appropriate Forum at once.
