Present:    Sh.MC Gupta, Adv. for complainant.

                 Sh.Rajiv Kumar Gupta, Adv. for respondent No.1.

     Respondent No.2 ex parte.

               

              On the basis of even date application filed by the complainant, file taken up on today.  Counsel for respondent No.1 who is present in another complaint titled as Jitender vs. Cholamandlam is verified about the application. Counsel for respondent No.1 suffered statement, according to which the respondent No.1 agreed to pay Rs.50280/- with the period of 60 days from today. Counsel for complainant agreed to it. Statement of counsel for complainant and statement of counsel for respondent No.1 recorded.

                In view of statement of the counsel for the complainant and respondent No.1, the present complaint is dismissed as withdrawn with no order as to costs. The respondent No.1 shall make payment of Rs.50280/- (Rs.fifty thousand two hundred eighty) only within the period of 60 days form today.  In default of it, respondent No.1 shall be liable to pay interest @7% p.a. (simple) on this amount of Rs.50280/- from the date of this order till actual realization. File be consigned to the records.
