Final Order / Judgement

Both the complainant and the O.Ps. are present by filing separate hajira through their Ld.Advocates. The O.P.nos. 1 and 4 have filed one bank receipt as per firisti showing deposit of cost of Rs.1,000/- in the Savings Bank Account of Consumer Legal Aid Fund, DCDRF, Jalpaiguri. Let the original bank deposit slips be kept in the record and inform the Registrar-in-charge.

             The complainant has filed a petition praying for withdrawal of the case. Perused the petition and the materials on record. Heard both sides. The O.Ps. raised no objection. In the said petition the complainant has stated that the dispute has been amicably settled with O.P. 1 and 4 out of Forum as per their own terms and conditions. The complaiannt has also stated that he has already received Rs.82,000/- by way of cheque from O.P. nos. 1 and 4 . As such he doesn’t want to proceed further with the case and wants to withdraw the case.

               It appears to us that the ground for withdrawal is genuine. Accordingly the prayer is considered and allowed.

              Hence, it is

O R  D  E  R  E  D  :-

            that the Consumer Case No. 52 of 2017  be and the same is withdrawn without any liberty to sue afresh. The parties to bear their own costs.

               Let a plain copy of this order be supplied to the parties free of cost. Let the original documents if any and the extra sets be returned to the complainant on proper acknowledgement. The case is thus disposed off.
