ORDER
The parties have settled the dispute before the Lok Adalat. Statement of Sh.Nitin Thatai, Counsel for OPs has been recorded. Statement of Sh.Sanjiv Gupta, Complainant in person has also been recorded, in view of which the complaint is ordered to be disposed of as settled. The parties shall be bound by statements made before the Lok Adalat today and the same shall form a part of this order. If OPs fails to pay Rs.15709/- to the complainant as per undertaking within a period of 45 days from today i.e. 23.12.2016, then OPs shall pay that amount of Rs.15709/- alongwith interest @ 12% p.a. from today i.e. 23.12.2016 till the payment is made        Certified copies of this order be sent to the parties free of cost. The file be consigned.

Statement of Sh.Nitin Thatai, Counsel for OPs.

Stated that OPs would pay Rs.10709/- as claimed by the complainant in the present complaint alongwith Rs.5000/- towards compensation & costs & litigation expenses. Further, the OPs undertake to reissue the policy No.110300/11119/6000091953 with all the back benefits accrued in the said policy and there would be no break in the said policy. Further, premium of Rs.15,635/- vide cheque No.122190, dated 23.12.2016 in favour of Apollo Munich Health Insurance Company towards premium of year 2016-17 is paid by the complainant today in the Forum. This policy would be valid for one year. The policy would be issued subject to realization of the said cheque. However, the coverage in the policy would start from today. Further the complainant would not raise any claim for the period till the time the policy was not in force till the present cheque is realized and policy is issued. The complainant should give an undertaking that he is not suffering from any pre existing disease as on today and is fit & healthy in all respects. The aforesaid payment of Rs.15709/- would be paid to the complainant within 45 days from today i.e. 23.12.2016.

I have heard the statement made by Sh.Nitin Thatai, Counsel for OPs today. I have no objection to the above settlement. I undertake that I am not suffering from any pre existing disease as on today and I am fit & healthy in all respects. This complaint be disposed of accordingly.
