1. This is a pathetic story of a student, who was subjected to cheating by an educational institution, which spoiled one precious year in his academic carrier and caused monetary loss. Attracted by an advertisement in news papers and in the brochure, he applied for the admission in Diploma in School Counseling Course, remitting Rs.10,000/- as Registration and first installment fee. This course intends to impart knowledge to individuals regarding case workup in children, identifying their problems and improving their performance. “The first and foremost in South India” was the first sentence printed in the brochure ie., Ext.A3. The opposite party offered high quality and value based education, with improved proficiency and competence. On 09-05-2012, the complainant has remitted Rs.500/- as registration fee, and Rs.9,500/- as first installment fee on 31-05-2012. the attested copy of the S.S.L.C. And +2 certificates, Four sets of passport size photographs were also furnished to the opposite party.
2. After receiving the fee and the said documents, opposite party promised to inform the date of commencement of the course. But, unfortunately, the complainant did not receive any information from the opposite party. Several requests made by the complainant to admit him in the course, or return the said amount collected from him, fell in deaf Ears. So, for the past 15 months the complainant was waiting for the response of the opposite party. Valuable one academic year was spoiled in his life.
3. Complainant came before this forum with the receipts issued by the opposite party and other relevant documents, which are marked as Ext.A1 to A4. The Notice, through registered post was issued to opposite party, which returned with an endorsement “Locked”. The Name of opposite party was called in the open court still absent. Obviously opposite party is evading the process of this forum willfully. Complainant was examined as PW1 who deposed in accordance with the written complainant. No contra evidence was adduced by opposite party. Complainant has proved his case. The opposite party is, undoubtedly, deficient in service. These kind of educational institutions are trying to attract the student with sweet words and false promises and cheating which results in spoiling the academic life of innocent students. This trend is to be discouraged.
4. In the result, the opposite party is directed to pay and return Rs.10,000/-(Rupees Ten thousand only) to the complainant, and to pay Rs.10,000/-(Rupees Ten thousand only) as compensation towards the unbearable mental agony and hardships he met, within one month of the receipt of the copy of this order.
