  1. In brief facts of the present case are that complainant is a resident of H.No. 97, Chander Lok Enclave, 3rd Floor, Pitampura, New Delhi-110034. It is stated that complainant has been using services provided by Anusha Technovision Pvt. Ltd. (herein after referred as OP-1) for Automation of various electronic equipments, products and applications of the OP-2 (herein after referred as OP-2 and OP-3). It is further stated that in June, 2020 complainant made one complaint for one of my curtain which was not working on Automation to OP-1 but after spending half day the engineer/technician of OP-1 failed to resolve the complaint, thereafter, the engineer revisited with curtain vendors representative and after re-examining/diagnosing informed that two motors of Lutron make along with one Module Lutron working and required to be replaced and at that time only one curtain was not working.

It is stated that Performa invoice dated 10.07.2023 for 2 motors and one Module issued amounting to Rs. 8,900/- however, due to COVID-19 pendemic and in view of the business scenario worldwide same was not followed up. It is further stated that on June, 2021 as a routine Apple Co. launched the updated version for software and its devices and complainant updated the Apple products such as Apple I-PAD and Apple I-PHONE.

It is stated that complainant has been using Crestron App and after updation faced difficulties to operate this App and received message “this App needs to be updated to work with this verison of Ios” contact your software provider. It is stated that on enquiry with ATPL it was informed to complainant that Cestron App has now become obsolete and Cestron had launched the new App which will have to be installed to operate this system on Apple I-PAD and I-Phone in future and there is a fee of Rs. 8,900/- The complainant got upgraded the App and paid Rs. 8900/- to the representative of ATPL and same was installed on 07.07.2021
  4. It is stated that complainant noted that officials of ATPL provided false and contrary information as after few weeks old App started working and functioning normally. It is stated that  officials of ATPL informed that they installed, configure and update the local product SML filed the new Crestron Go App to make functional I-PAD and IPHONE.  Visit of engineer was arranged and complainant also enquired regarding the pending curtain work and it was told that motors were not purchases from ATPL but from curtain vendor. It is further stated that on enquiry from curtain vendor it came to the knowledge that curtain vendor has no more dealing with Lutron any more and same cannot be replaced. It is further stated that the team leader of ATPL was informed that to take the warranty replacement of these motors and modules at his company level and provided best discount price.  It is stated that party discount price was provided but price on Lutron products have been increased about more that 10%.
  5. It is stated that on 07.07.2021 a visit was arranged and one Mr. Dharmender on behalf of ATPL visited to get curtain work and Crestron App work done. It is further stated that after spending 4to 5 hours to install, configure the new Lutron motors and Lutron module and after installation of motors and module he was trying to run the curtain through the App and Crestron Go App but was not able to made its end then representative tried to close the curtain forcefully by using process which resulted in rupture  of the belt with a loud noise and curtain got hanged/temper/busted. It is stated that representative of ATPL informed that belt will also be needed to replace and he will bring new belt from the office in a day of two.

It is stated that the representative started configuring this Crestrone Go App to make it functional on the IPAD and IPHONE and an upgraded Icon appeared which was mandatory to be upgraded to make the Crestron Go App functional as per the representative was throughout taking instructions on telephone line from Senior officials of ATPL. It is stated that after spending 2 hours he was able to active the Cristrone Go App on the IPAD and mobile phone but it was working only on Wifi Network and not on  4G Network.

It is stated that after discussion with Mr. Tarun Shrivastave representative of ATPL revisit  was arranged of the representative on 09.07.2021 for completing the pending curtain work and replacing the belt. The representative of ATPL kept on examining the fault but none of the light through Cristrone Key Pad or Apps were  working and all the appliances were on a standstill. It is further stated that complainant was informed that while configuring the curtain by around 2 to 4 modules have got damaged for which Mr. Dharmender one of the representative had informed his senior officials. The representative intimated that they will again revisit on 10.07.2021.
  8. It is stated aht while examining it was noticed that few other things were not working and was on a standstill such as  cove lights, Drawing Room curtain, Roller curtain etc. which were not in operate from Crestron Key Pad or
    App. And same was informed to the representative. It is further stated that the above incidence and negligent behavior of the representative/team members of ATPL was briefed to OP-1,2 & 3 through Email dated 10.07.2021, on 12.07.2021 and thereafter a reminder Email also sent on 30.07.2021.
  9. It is stated that Sh. Avnish Kumar Director of OP-3 assured that issues will get resolve by ATPL  vide reply to Email dated 30.07.2021. it is further stated that none of the representative of Lutron and management of Anusha
