The son of the Complainant in First Appeal No. 703 of 2017 and the Complainant in First Appeal No. 704 of 2017 are present in person. We are happy to note that the proposal made on behalf of the Appellants on the last date of hearing, viz. refund of the principal amount to each of the Complainants, along with interest @ 12% p.a. from the date of respective deposits till actual realization, is acceptable to both the Complainants. Admittedly, 50% of the principal amount(s), deposited by the Appellants, has already been received by them. Learned Counsel appearing for the Appellants submits that two cheques, both dated 22.08.2017, in the sums of ₹19,77,126/- and ₹18,63,832/- in favour of the Complainants, Smt. Supriya Rani and Anurag Gupta respectively, drawn on Punjab National Bank, Connaught Place, New Delhi, towards the balance 50% of the principal amount(s), deposited by the Complainants, have been handed over to them. Learned Counsel has assured us that the cheques shall be honoured on presentation. In view of the above, we dispose of both the Appeals, on consent, with a direction that simple interest @ 12% p.a. on the amounts deposited by the Complainants with the Appellants from the date of respective deposits till 23.10.2017, by way of demand drafts drawn in favour of the Complainants, shall be remitted by the Appellants to each of the Complainants on or before the said date. On receipt of the said drafts, the Complainants shall not be left with any claim against the Appellants, subject matter of the Complaints, giving rise to the present Appeals. If the afore-noted amounts are not remitted by the Appellants to the Complainants, it will be open to them to have the present Appeals revived. The statutory amount deposited by the Appellants at the time of filing the Appeals shall be refunded to them. |
