Case called out repeatedly. Complainant is absent. O.P. No.2 and 3 are present through Counsel. It appears from perusal of the record that the complainant is not appearing since long back. Only O.P’s are appearing on each and every date. O.P.No’s 2 and 3 have mentioned in there written statement and counter affidavit that the maturity amount was paid to the complainant vide cheque no. 398282 dated 26/11/2011 and as per the Saving Bank Control Organization, Agra Fort Head Office. This cheque was deposited in Saving Bank Account No.861803 of the complainant. The O.P. No.1 has also mentioned this fact in his written statement and Counter affidavit. The complainant has not filed rejoinder affidavit against the counter affidavits filed on behalf of the O.P’s. He has also not filed any other evidence to prove the allegations contained in his complaint therefore, this Forum is unable to hold deficiency in services of the O.P.’s. Consequently, the present complaint is liable to be dismissed accordingly. Let record be consigned.
