Heard Sh. Suresh Gautam, learned counsel for the applicant and perused the record.
This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 25,000/-, which was deposited by the applicant towards mandatory deposit while filing First Appeal No. 132 of 2018; The New India Assurance Company Limited Vs. Smt. Anupreet Kaur Sethi.
The aforesaid appeal was filed by the applicant before this Commission against the judgment and order dated 27.08.2018 passed by the District Commission, Udhamsingh Nagar in consumer complaint No. 13 of 2017; Smt. Anupreet Kaur Sethi Vs. The New India Assurance Company Limited.
This Commission vide order dated 03.08.2022 has dismissed the aforesaid appeal.
According to office report dated 07.04.2024 / 20.04.2024, the applicant has deposited the entire decretal amount before the District Commission, which has been paid to the opposite party and the District Commission vide order dated 01.10.2022 passed in execution application No. 35 of 2018; Smt. Anupreet Kaur Sethi Vs. The New India Assurance Company Limited, has dropped the proceedings of the execution application in full satisfaction of the decree.
In view of above, the miscellaneous application is allowed. The aforesaid amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) deposited by the applicant with this Commission, be released in favour of the applicant.
File be consigned to the record room along with copy of this order.
