ORDER

Per Mr. Justice Ashok Kumar, President: This revision petition under section 47(1)(b) of the Consumer Protection Act, 2019 has been filed by which the impugned order passed by the ld. District Consumer Commission, Orai at Jalaun in complaint case no.28 of 2024 dated 18.7.2024 has been challenged.

          Admittedly, the written statement has been filed by the revisionist before the ld. District Consumer Commission beyond prescribed time which has not been accepted by the ld. District Consumer Commission. However, the ld. District Consumer Forum has fixed ex-parte hearing of the complaint no.28 of 2024 on 3.9.2024, against which the instant revision petition has been filed.

          Having heard the ld. counsel for the revisionist, without going into the merits of the case I am of the view and in the interest of justice the instant revision is finally disposed of by directing the ld. District Consumer Commission to hear the parties on merits in accordance with law ignoring the previous order passed by the ld. District Consumer Commission dated 18.7.2024.

          So far as the opportunity of filing of written statement has been expired, therefore, no further opportunity will be allowed.  

          The revision petition is finally disposed of.

          A certified copy of this order be made available to the parties as per rules.

          The Stenographer is requested to upload this order on the website of this Commission at the earliest.
