By Smt. Padmini Sudheesh, President: The complaint is filed to get back the amount paid to the respondent firm. The case is as follows. Believing respondent’s words that the money borrowed will be returned with attractive terms the complainant paid Rs.11,815/- on 7.8.07 and Rs.2400/- on 23.8.07. The respondent issued receipts for the payment and agreed to repay with interest when required. The complainant approached several times to get back the amount. But the amount has not been returned back. Hence the complaint. 2. The respondent called absent and set exparte. 3. The complainant filed affidavit and produced the receipts to prove his case. They are marked as Ext. P1 to P3. 4. The definite case of the complainant is that on believing the words of the respondent that the money borrowed will be returned with interest and also with attractive terms he paid the amount as per Ext. P1 and P2 receipts. But the money paid was not returned so far even though he approached the respondent several times to get back the amount. According to him, he is liable to get back Rs.11,815/- with interest and he produced the Ext. P1 and P2 receipts. There is no evidence to the contrary. 5. In the result, complaint is allowed and the respondent is directed to return the amount stated in Exts. P1 and P2 receipts with interest at the rate of 12% per annum from the date of deposit till realization and Rs.1000/- as cost to the complainant within one month.
