JUDGMENT

JUSTICE SHRI.K.R.UDAYABHANU    : PRESIDENT

            The appellant is the 6^th opposite party in O.P. 1360/04 in the file of CDRF, Thrissur.  The opposite parties including the appellant is under orders to refund Rs. 1,000/- with interest of 9% from 30.4.2003 and also to return Ext. P2 amount (20,000/-) and interest at 9%  per annum from 29.10.2001 and cost of Rs. 500/-

          The matter is with respect to the amounts allegedly deposited  in the first opposite party finance out fit.

          It is the case of the appellant that he was not a partner of the 1^st opposite party firm.   He had produced the extract of the register of firms maintained by the Registrar of Firms with respect to the 1^st opposite party firm.  The above documents were produced before the Forum.  But the Forum has not considered the same.  We find that in the above document there are the names of 20 partners.  The 11^th partner is one E.K. Francis S/o Kunjuvaried as in the extract of register of firms.  The appellant is N.R. Francis S/o Rappai.  The residential address is also different.  The firm has ceased to function also and the assets are with the official receiver appointed by the Civil Court.

          The complainant/1^st respondent stands ex-parte before this Commission.

          In view of the copy of the register of firms with the Registrar of Firms produced we find that the appellant was not a partner of the Firm and hence the direction to pay the amount by the appellant by the Forum below can not be sustained.  The above order is modified to the effect that opposite party/appellant herein will not be liable to make the payment as ordered by the Forum.

          The appeal is allowed.
