Today none has appeared on behalf of any of the party inspite of several calls.

A perusal of the order sheet has depicted that since a long time, the appellant – applicant has been given sufficient opportunity to take fresh steps for issuance of notice on respondent Nos. 2 & 3 by both ways as well as by publication in local newspaper, but the such steps were not taken by the appellant – applicant.

Today appellant alongwith its counsel has not appeared.

This case is fixed for hearing of application for the purpose of condoning the delay for a period of three years four months and 25 days in filing the appeal, but today none has appeared on behalf of the appellant – applicant to press the delay condonation application.

In such circumstances, in the absence of the parties and on account of not taking the proper steps as well as on account of non-compliance of the order of this Commission, the delay condonation application is hereby rejected and the appeal is summarily dismissed. No order as to costs.

File be consigned to the record room alongwith copy of this order. The copy of this order alongwith original file be sent to the District Commission concerned for perusal and necessary information.
