ORDER

It is stated at bar by the Counsel for the appellant that in terms of order passed by this Commission, the entire decreetal amount i.e. Rs.2,15,000/- stood deposited with the registry of this Commission.

                At the time of arguments, both the parties have shown utmost grace and the matter has been settled amicably.

                It is stated that for a benevolent cause, out of the amount so deposited i.e. Rs.2,15,000/-, an amount of Rs.2 Lakhs be released in favour of PGIMER, Chandigarh, on behalf of the appellant & other respondent(s) who were opposite parties before the Forum, to discharge their corporate social responsibility and the remaining amount of Rs.15,000/- alongwith interest which may have accrued on the entire of Rs.2,15,000/-, be released in favour of respondent No.1/complainant, namely, ‘Anshul Goel’.

                As per office report, the aforesaid amount of Rs.2,15,000/- is lying deposited with this Commission in the shape of Fixed Deposit Receipt(s).

                In view of above, we make it very clear that the findings given by the Forum in the judgment, which has been impugned in this appeal, will not be read as precedent against the appellant & other respondent(s) who were opposite parties before the Forum. However, if any independent complaint is filed in future, the same may be decided without being influenced by observations made by this Commission in this order and the  impugned order passed by the Forum.

                As such, as per settlement arrived at, the judgment under challenge has become infructuous.

                The Secretary of this Commission is directed to get the aforesaid FDR(s) liquidated and release an amount of Rs.2 Lakhs only to the PGIMER, Chandigarh. Let the cheque be prepared in the name of competent officer after getting necessary information from the Medical Superintendent/Director of PGIMER, Chandigarh. The amount, so released, shall be deposited in the Poor Patient Welfare Fund (PPWF) maintained by PGIMER, Chandigarh.

                The balance amount of FDR(s) including interest, after releasing an amount of Rs.2 Lakhs to PGIMER, Chandigarh, be released in favour of respondent No.1/complainant, namely, ‘Anshul Goel’.

                Needful be done within ten working days from today.

                Accordingly, the appeal stands disposed of.

                Certified copies of this order be sent to the parties free of charge.
