Heard Sri Manish Arora, ld. counsel for the appellant.

          The instant appeal has been filed against the order passed by the Ld. District Consumer Forum-II, Agra in Complaint Case No. 54 of 2020 dated 19.5.2023.

          The submission of the ld. counsel for the appellant is that on account of personal unavoidable reasons, the counsel for the complainant could not appear before the court on various dates fixed, as the diary which has been maintained with regard fixation of the dates by the ld. court misplaced in his office.

          Having heard ld. counsel for the appellant, though there are various dates fixed by the ld. District Consumer Forum and opportunities allowed to the complainant/counsel for the complainant, the case has been finally dismissed for want of prosecution. Therefore, we request the ld. District Consumer Forum-II, Agra to provide one opportunity to the complainant to argue his complaint case before the ld. District Consumer Forum on merit.

          It is clarified that no adjournment will be allowed either of the parties by the ld. District Consumer Forum in complaint case no.54 of 2020 which is restored to its original number, by this court. The said complaint must be decided on merits within a period of six months from today. 

          A certified copy of the order will be placed by the appellant/complaint within two weeks from today.  

          The Stenographer is requested to upload this order on the website of this Commission at the earliest.
