Consumer Complaint No.220 of 2015

 

  1. Sh.Harjinder Singh son of S.Surjit Singh
  2. Rajbir Kaur wife of Mr.Harjinder Singh

Both complainants are residents of House No.4553 A, Sector 70, Near Vivek High School, Mohali.

Versus

  1. Ansal Properties and Infrastructure Ltd., 1202-1204, Antriksh Bhawan, 22, Kasturba Gandhi Marg, New Delhi – 110001, through its MD.
  2. Ansal Properties and Infrastructure Ltd., SCO No.183, 184, Sector 9-C, Madhya Marg, Chandigarh, through its Sr. Executive (Sales and Marketing)/Branch Manager/Authorised Signatory.  

                                          ….Opposite Parties.

Complaint under Section 17 of the Consumer Protection Act, 1986.

ORDER

             

            It is stated by Counsel for the Opposite Parties that possession of the unit, in question, shall be handed over to the complainants complete in all respects within six months i.e. on or before the end of June 2016. It is further agreed that the amount already deposited by the complainants, the Opposite Parties shall pay interest @12% per annum (simple) to be calculated from 17.5.2012 up to 31.5.2016. As a goodwill gesture, it is further agreed that the Opposite Parties shall pay an amount of Rs.2,25,000/- to the complainants.

2.         The above amount shall be paid/adjusted at the time of handing over of possession. The adjustment is likely to be made towards statutory liability and maintenance charges etc. from the date of handing over of possession.

3.         The above proposal is acceptable to the Counsel opposite.

4.         It is made clear that, in case, the commitment made by the Opposite Parties is not honoured, liberty shall remain with the complainants to file a fresh complaint.

5.         In view of above compromise arrived at between the parties, the complaint is disposed of.

6.         Certified copies of the order be sent to the parties free of charge.
