  1. This order shall dispose off an application u/s 40 of the Consumer Protection Act, 2019, for review of order dated 05.12.22.This application has been filed by the Complainant.
  2. Briefly stated the facts necessary for the disposal of this application are as under:

The Complainant has filed a complaint u/s 35 of the Consumer Protection Act, 2019 against the Opposite Party named above. Vide order dated 05.12.22 the complaint was allowed. Vide the said order the Opposite Party was directed to pay a sum of Rs. 9,63,627/- along with interest @ 6 % p.a. from the date of deposit till recovery. The case of the applicant/complainant is that the Hon’ble National Consumer Disputes Redressal Commission has awarded interest @ 8 % p.a. in similar cases and therefore on the ground of parity the applicant is also entitled to interest @ 8 % p.a. It is prayed that order dated 05.12.22 be reviewed accordingly.

  1. We have already heard the AR of the Complainant and have perused the file.
  2. Section 40 of the Consumer Protection Act, 2019 provides that a District Commission shall have the power to review its order if there is any error apparent on the face of record. In the present case, interest @ 6 % p.a. has been awarded to the Complainant vide order dated 05.12.22. Vide a said order interest @ 8 % p.a. was never awarded to the Complainant. Therefore, there is no error apparent on the face of record. Hence, the application is not maintainable. The application is dismissed.
  3. Order announced on 30.01.23.

Copy of this order be given to the Applicant/Complainant free of cost.

File be consigned to Record Room.
