1. This Revision application is directed against the order dated 15-04-2017 in Complaint Case No. 08 of 2012 passed by the District Consumer Forum, Arwal rejecting the Petition dated 29-03-2017 holding the same as not maintainable. By the aforesaid petition the Petitioner has prayed for hearing of the complaint case No. 28 of 2011 pursuant to the order passed by the State Commission vide 10 of 2015 order dated 18-09-2014 in Appeal No.- 325 of 2012 remanding the matter for hearing the aforesaid complaint case, after setting aside the order under appeal. The Petitioner filed Revision before the Hon’ble National Commission vide Revision No.- 4389 of 2015. The said case was dismissed for non prosecution as also observing that State Commission had already remanded the matter vide order dated 22-07-2015.

2. We are not recording the details of the development of the case in between the petitioner or the Opposite – party as those are not relevant for the present after the order passed by the State Commission in Appeal No. 325 of 2012 and the Revision Petition No.- 4389 of 2015.

3. In view of the above we set aside the order under Revision and direct the District Consumer Forum to dispose of the Complaint Case No. 28 of 2011 / 10 of 2015 in accordance with law after giving opportunity to both sides in support of their cases expeditiously. The Execution proceedings in view of the above no longer remains for Execution.

4. In the result, Revision Petition stands allowed.
