1. Kala Singh, complainant has preferred the present complaint against the opposite party (referred to as OP in short) on the ground that he purchased bottle of oil from the OP for an amount of Rs.2500/- after seeing the advertisement of OP on television for the purpose of knees problem which was delivered to the complainant by employee of the OP. As per advice of the OP, the complainant properly applied the said oil on knees and finished the same in 30 days but he has not got any relief. The OP assured that if problem of complainant will not cure within 10 days then OP will return the amount taken but they did not do so. Thus, alleging unfair trade practice on the part of OP, the complainant has sought following reliefs:-
i) OP be directed to repay the amount of Rs.2500/- alongwith upto date interest,
ii) OP be directed to pay to the complainant a sum of Rs.20,000/- on account mental agony and harassment and to pay Rs.5500/- as litigation expenses.
2. Notice was sent to the OP but none has appeared for the OP. As such OP was proceeded exparte.
3. The complainant has tendered documents Ex.C-1 to Ex.C-5 and closed evidence.

The complainant's specific case is that he had purchased bottle of oil from the OP for an amount of Rs.2500/- after seeing the advertisement of OP on television for the purpose of knees problem which was delivered to him by employee of the OP which is evident from invoice dated 23.09.2017 Ex.C-3 on record. The complainant has further stated that as per advice of the OP, the complainant properly applied the said oil on knees and finished the same in 30 days but he has got no relief and the OP assured that if problem of complainant will not cure within 10 days then OP will return the amount taken but they did not do so. The complainant has also produced on record copy of legal notice dated 03.11.2017 Ex.C-4 and its postal receipt Ex.C-5 which also prove that the same was sent to the OP but OP did not give any reply. The OP has not come forward to contest the case rather they chosen to remain exparte. As such evidence produced by the complainant has gone unrebutted on record.
5. In view of the above discussion, we allow the complaint and direct the OP to refund an amount of Rs.2500/- being cost of the oil. We further direct the OP to pay to the complainant an amount of Rs.2500/- being consolidated amount of compensation.
6. This order of ours shall be complied with within 30 days from the receipt of copy of the order. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
