            Heard the complainant regarding the maintainability.  After perusal of the documents, nowhere seen any documents to connect the cause of action arose within the jurisdiction of this Forum.  The transaction is purely at Cochin.  Moreover, opposite party is the Counsel who sent registered lawyer notice on behalf of the company, on whom the complaint alleges deficiency.  How the Counsel appeared as an opposite party, no explanation put forward by the complainant during the time of hearing.   In such circumstances complaint dismissed due to lack of territorial jurisdiction.

 

            Pronounced in open Court this the 27th day of February 2009.
