          Case called thrice.  None appeared on behalf of appellant.   On the last date of hearing, appellant withdrawn the application for condonation of delay in filing the appeal and prayed for time to file fresh application for condonation of delay, which was accordingly granted. 

2.      Today neither fresh application for condonation of delay has been filed by appellant, nor has anyone turned up on behalf of appellant.  This shows that appellant is not interested in pursuing the case.  Accordingly, this appeal is dismissed in default. 

3.      Misc. Application, if any, pending is disposed of.
