Case called out repeatedly. Parties are absent. None has appeared on behalf of both the parties. It appears from perusal of the record that only the O.P. was appearing till 20/12/2016. The complainant is not appearing since long back. He has not filed rejoinder affidavit against the counter affidavit filed by the O.P. The O.P. has categorically mentioned in his written statement and counter affidavit that, nephew of the complainant Mr. Lokpal has sold out 52 packets of potatoes out of 108 packets, according to the directions of the complainant. The O.P. has annexed copy of receipt dated 01/10/2013. He has also mentioned that remaining 56 packets were not taken back by the complainant, as he had no money to pay the rent and he has filed the present complaint with wrong allegations. The complainant has not filed rejoinder affidavit against counter affidavit filed by the O.P. The allegations contained in the complaint do not find support from the evidence filed by the complainant on the record.

                   In view of the above, the present complaint is liable to be dismissed. This complaint is dismissed accordingly. Both the parties shall bear their own costs.
